Media Drug Attorney Doesn’t Want To Blame Dealers For Drug-Related Deaths

The recent movement to prosecute overdose deaths as homicides has some problems, according to a Media drug attorney. While it may quell small-time drug deals, it won’t stop the problem.

Within Pennsylvania and several other states, there have been groundswells in the support for prosecuting overdose deaths as homicides. This movement aims to punish drug dealers for the deaths of their customers due to overdoses and poor drug quality.

Arik Benari, of The Benari Law Group comments: “The problem with the idea isn’t that drug dealers should get punished. Instead, it is the idea that the buck should stop there. These drug dealers are often selling drugs they know nothing about – they just receive the products and push them. The drug lords are the ones to blame for overdoses and poisonous products.”

Called drug delivery resulting in death (DDRD), drug dealers who are found guilty will face imprisonment of 20 to 40 years. Proponents suggest that this type of law will help grieving families, scare off would-be drug dealers, and even help find the drug lords.

“I don’t see the path forward from arresting these small scale drug dealers,” Benari, a Media drug attorney, says. “Once arrested, the drug dealers will not reveal who their contacts are – that is extremely dangerous for them and for their families. The idea isn’t a bad one, it just doesn’t go far enough to provide a framework for how it will actually work.”

Still, there is a chance for Pennsylvania to set a precedent for this type of case, according to the Media drug attorney. “We can do something really powerful here, if we are willing to take chances.”
